► Help4teens Website Terms and Conditions of Use:

Help4Teens provides its information services on this website subject to the following terms and conditions of use (TCU). Where Help4Teens is referred to in this TCU it may be considered in its wider context as part of the Children and Young People’s Service of Durham County Council, and is working within and in compliance with the policies and procedures established by Durham County Council. TCU document may be updated from time to time without notice any update will replace all previous versions.

► User Policy

1. Help4Teens is not responsible for inaccurate or misleading content on any external site linked directly or indirectly to the Help4Teens ‘Help4teens‘site. Consequently, Help4Teens shall not be liable for any claims for damages or loss as a result of information or other goods or services offered on other sites.

2. Help4Teens urges you to use discretion while browsing the internet and using its services. Help4Teens cannot accept responsibility for the accuracy, copyright or data protection compliance or legality of any information or other content found on sites other than the ‘Help4teens’ site.

3. Help4Teens does not endorse any sites on the internet linked directly or indirectly to the Help4Teens ‘Help4teens’.site. Help4Teens provides such links purely for convenience and Help4Teens is not responsible for any content, products, services or other materials available from linked sites.

4. Help4Teens respects your rights and those of its users. We reserve the right to refuse to post, display or otherwise transmit any materials which would violate a person’s privacy or constitute an offence under the law or be in breach of any other Help4Teens policy or regulation. ‘If any such posts are inadvertently made we reserve the right to remove these.

5. Help4Teens is not obliged to monitor every transaction made on its servers or to edit, delete or refuse to transmit data on its site or servers.

6. Help4Teens reserves the right to bar, any user who acts in violation of Help4Teens’s policies, terms of use or who acts in violation of the law or other applicable regulation.

► Privacy Policy

7. Help4Teens values and protects the information you provide to us. Help4Teens is registered under the Data Protection Act (1998) and undertakes to comply with all applicable UK data protection legislation currently in force. This policy outlines what information we collect and how this is used by Help4Teens.

8. This policy is only applicable to information you provide to Help4Teens, not to the practices of other companies not owned or controlled by Help4Teens. When dealing with such organisations you should take care to read their own privacy statements and terms of use documents.

► Indemnity

9. You agree to indemnify and hold us and our subsidiaries, affiliates, employees, officers, agents or partners harmless from and against any direct or indirect loss or damage (including consequential loss and loss of profits, goodwill or business opportunities arising from any third party claim in relation to any content you upload, post or e-mail on our through our message system or our site, or your breach of the provisions of these rules.

10. Sanctions

10.1. As soon as we are made aware of activities that breach these terms of use, prompt action will be taken. If you witness such breaches on this site please notify the Information Coordinator immediately at: help4teens@durham.gov.uk

10.2. On being made aware of any such breaches we may ban, delete or prohibit any content that relates to those breaches or that we judge harmful to individuals or the rights of Help4Teens, or any of our affiliates, licensers or partners.

10.3. We reserve the right to take whatever action we deem necessary to prevent such breaches including the following:

10.3.1. Breaches we deem minor may result simply in receipt of a warning from the Help4Teens.

10.3.2. Breaches we deem serious may result in your automatic ban from our site generally. All incidents will be logged and our decision is final in all such cases.

10.4. Any breaches may lead to us reporting your activities to your internet service provider, your employer, relevant authorities, or to legal action being taken against you, or both.

10.5. In addition we may at any time move, modify or remove any content or take further legal action as a result of breaches or suspected breaches or these rules, our privacy policy, any applicable laws or regulations or where our rights or third party rights are threatened or infringed.

11. Cookies

11.1. Cookies are small text files placed by your web browser on your computer’s hard disk drive and can be used to provide further information about the user’s hardware, your personal site preferences and the current user session. The Help4Teens site requires cookies to be enabled. Therefore, as a TCU, Help4Teens may set and access cookies on your computer’s hard drive. Help4Teens cookies are not accessible to third parties and we will not disclose the information contained within them.

12. Log files

12.1. The log files used for the Help4Teens site record the URLs of visited pages, browser type and other hardware/software details for our users. This information is not personally identifiable and is used purely for tracking general user movement, in site administration, and for collating demographic data.

► Access

13. We do not represent or warrant that access to the Help4Teens ‘Help4teens’ site, or any part of it will be uninterrupted, reliable or fault free.

14. We reserve the right in our sole discretion to deny users access to the Help4Teens ‘Help4teens’ site or any part of it without notice, and to decline to provide the service to any user that is in breach of these terms and conditions of use.

15. By using the site you agree to adhere to all applicable laws, treatises and regulations, whether local, national, European or International. Additionally you agree to not use the Help4Teens internet service to:

15.1. Use information or resources (e.g. e-mail) from this site to send ‘spam’ or other unsolicited messages.

15.2. Collate and/or assemble data regarding other users, including email addresses or other personal information without their consent.

15.3. Issue via email, forum, chat or other mechanism unlawful, harassing, libelous, abusive, tortuous, defamatory, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind.

15.4. Breach the copyright of any creative or intellectual work. You must not send or store information which you do not own the copyright for or otherwise have a licence to use.

15.5. Transmit any material containing software viruses or other harmful computer code, files or programs such as trojan horses, worms, timebots or other malicious code.

15.6. Interfere with or disrupt servers or networks connected to the Help4Teens service or violate the regulations, policies and procedures of this network.

15.7. Attempt to gain unauthorised access to the Help4Teens internet service user accounts or computer networks connected to the Help4Teens site by any means.

15.8. Harass or otherwise interfere with any other user’s use of the Help4Teens site.

15.9. Impersonate any person or otherwise misrepresent yourself or your association with a person or entity.

16. While Help4Teens is not obligated to monitor the service and/or content or individual usage it reserves the right to monitor, review, retain and/or disclose any information which may be necessary to comply with any regulation, legal process, investigation or governmental request.

► Copyright

17. All rights in the design, text, graphics and other material on our site and the selection and arrangement thereof are the copyright of Help4Teens or other third parties.

18. Permission is granted to electronically copy and print in hard copy portions of this site solely in connection with the acquisition of goods or services through the site. Any other use of materials on our site (including reproduction for purposes other than those noted above and alteration, modification, distribution, or republication) without prior permission is strictly prohibited.

19. We reserve the right at any time without notice to revise the content of our site (including the services offered by us) and these terms of use. Any changes to these terms of use will be posted on our site and by continuing to use our site following any such change you will signify that you agree to be bound by the revised terms and conditions of use.

► Disclaimer of Warranties

20. Help4Teens makes no representation, warranty or guarantee as to the reliability, timeliness, quality, suitability, truth, availability, accuracy or completeness of the service or any content. Help4Teens does not represent or warrant that:

20.1. The use of the site will be timely, uninterrupted or error free or operate in combination with any other hardware, software, system or data.

20.2. The site will meet all of your requirements or expectations.

20.3. Errors or defects will be corrected.

20.4. The service or the server(s) that make the service available are free of viruses and other harmful components we shall not be liable to you for any breach of these terms of use or any failure to provide or delay in providing our services through our site resulting from any event or circumstance beyond our reasonable control including, with limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, fire, explosion or accident.

21. This statement of Terms and Conditions of Use constitutes the entire agreement between you and Help4Teens and it governs your use of the site. The TCU is governed by the laws of England and you agree to submit to the exclusive jurisdiction of the English courts. Any failure by Help4Teens to exercise or enforce the rights and provisions of the TCU does not constitute a waiver of rights or provision.
